Terms and Conditions of Use

almaigliah.com Platform (Al Maigliah Platform)

(1) Definition and Nature of the Service
almaigliah.com is a Saudi electronic platform that enables merchants to create online stores to display products limited to oud, incense, and perfumes only.
The platform does not conduct sales on its own behalf, does not own, store, or ship products, and does not represent any party in the contractual relationship between the merchant and the consumer.
The platform acts as a “technical enabler” in accordance with the concept of e-commerce service providers and is not considered a party to contracts concluded between users.
This service (creating online stores) is provided free of charge (100%) to encourage e-commerce and contribute to the Kingdom’s Vision 2030.

(2) Scope of Liability
All sales, purchases, offers, guarantees, and statutory obligations are solely the responsibility of the merchant.
The platform does not process, receive, or transfer any payments and does not provide electronic payment gateways.
Any agreement between the merchant and the consumer is concluded directly between them through the platform’s messaging system or via other communication methods agreed upon by the parties.
The platform fully disclaims liability for:
The accuracy, quality, or conformity of products to their descriptions.
The execution, cancellation, or delay of orders.
Any financial losses or direct or indirect damages resulting from transactions.
No party shall have the right to file any financial claim, compensation request, or legal action against the platform in relation to any transaction conducted between a merchant and a consumer.

(3) Compliance with the E-Commerce Law
The merchant must comply with the provisions of the Saudi E-Commerce Law and its Implementing Regulations, including:
Clearly disclosing commercial information.
Stating product characteristics and price inclusive of fees.
Clearly specifying exchange and return policies.
The merchant bears sole legal responsibility before the competent authorities and the consumer.

(4) Refund Request Notification Tool
The platform provides a technical tool to notify the merchant of refund requests submitted by consumers.
This tool is merely an electronic notification and does not constitute acceptance, rejection, arbitration, or a legally binding obligation.
The platform does not intervene in refund decisions nor impose any obligation on any party.

(5) Disputes
In the event of a dispute between a merchant and a consumer, they must resolve it amicably or refer the matter to the competent judicial authorities in the Kingdom of Saudi Arabia.
The platform is not an arbitration body or dispute resolution authority.
The platform bears no responsibility for dispute outcomes or court judgments.

(6) Prohibited Content and Goods
It is prohibited to display any goods that violate Saudi laws or that affect public health, security, or public morals.
The platform reserves the right to remove any violating content without prior notice.
The platform also reserves the right to suspend or terminate accounts in case of violations of laws or this agreement.

(7) Data Protection
The platform is committed to complying with the provisions of the Personal Data Protection Law in the Kingdom of Saudi Arabia regarding the collection, processing, and storage of data.

(8) Amendments
The platform may amend these terms at any time, and continued use constitutes acceptance of the amendments.

(9) Governing Law and Jurisdiction
This agreement is governed by the laws and regulations of the Kingdom of Saudi Arabia, and Saudi courts shall have jurisdiction over any dispute arising between the user and the platform.
